Terms of Service

These Terms govern your use of the Elya mobile application ("Elya", "the app", "we", "us"), operated by GyEffe Technologies Ltd (company number SC899700), a private limited company registered in Scotland with registered office at 5 South Charlotte Street, Edinburgh, EH2 4AN. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use Elya. Please also read our Privacy Policy and Child Safety Policy.

1. Eligibility

You must be at least 13 years old to use Elya. If you are under 18, you may use Elya only with the knowledge and permission of a parent or guardian. By using Elya you confirm you meet these requirements.

2. The service

Elya provides AI-powered companionship and language-learning features. The characters are artificial intelligence, not real people, and the app is intended for general education, entertainment, and language practice.

3. AI content — important disclaimer

Responses in Elya are generated by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your situation. Elya provides general educational information only and is not professional advice. It is not a substitute for a qualified doctor, lawyer, financial adviser, therapist, or other professional. Do not rely on Elya for medical, legal, financial, or other professional decisions; consult an appropriate professional for your specific circumstances. Elya is not an emergency or crisis service.

4. Acceptable use

You agree not to use Elya to: break the law; harm, harass, or endanger others; attempt to generate sexual content involving minors or other prohibited content; reverse-engineer, disrupt, or misuse the service; or impersonate others. We may remove content, restrict features, or suspend accounts that breach these Terms.

5. Accounts

You are responsible for keeping your account credentials secure and for activity under your account. You agree to provide accurate information when registering.

6. Subscriptions and billing

Elya offers a free experience and an optional paid subscription ("Premium"). Subscriptions are sold and billed through Google Play, and are subject to Google Play's terms in addition to these Terms.

7. Intellectual property

Elya, including its software, characters, and content, is owned by us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose. You retain rights in the content you submit, and grant us the limited licence needed to operate the service (for example, to process your messages to generate responses).

8. Disclaimers

Elya is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including warranties of accuracy, fitness for a particular purpose, or uninterrupted availability. Nothing in these Terms excludes any liability that cannot be excluded under applicable law (including, for consumers, your statutory rights).

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for any reliance you place on AI-generated content. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the event giving rise to the claim. This does not affect liability that cannot be limited by law, such as for death or personal injury caused by our negligence, or your non-excludable consumer rights.

10. Indemnity

To the extent permitted by law, you agree to be responsible for losses we suffer arising from your misuse of the app or your breach of these Terms.

11. Termination

You may stop using Elya and delete your account at any time, from Settings → Account removal → Delete account inside the app, or by writing to support@meetelya.com. Deletion is permanent: see Delete your account for exactly what is removed and what we must keep. We may suspend or terminate access if you breach these Terms or where necessary to protect users or comply with the law.

12. Governing law

These Terms are governed by the laws of Scotland, and the Scottish courts have jurisdiction, without affecting any mandatory consumer-protection rights you have in your country of residence.

13. Changes

We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.
